Terms and Conditions
These terms explain the general conditions that apply to work completed by Max Power Electrical & Airconditioning.
These terms are intended to be read alongside any written quote, estimate, invoice, accepted scope of works, product documentation or written agreement provided by Max Power Electrical & Airconditioning. Customers should obtain independent advice where required, including legal, financial, building, engineering, energy or product advice.
1. General
These terms apply to electrical, solar, battery, air conditioning, commercial and related works carried out by Max Power Electrical & Airconditioning. All works are subject to the written quote, estimate, invoice, accepted scope of works or other written agreement accepted by the customer.
2. Estimates and Quotations
Indicative estimates are provided as a guide only. Formal quotes are based on the information available at the time, including site access, visible site conditions, customer requirements, product availability and the known scope of works.
Additional costs may apply for unforeseen works, materials, customer-requested changes, compliance requirements or site conditions that were not visible or reasonably known at the time of quoting.
3. Solar and Battery Savings Disclaimer
Any solar, battery, EV charging or energy savings estimate is an estimate only. Max Power Electrical & Airconditioning does not guarantee savings, payback period, return on investment, export income, bill reductions or energy performance outcomes.
Actual results may vary depending on electricity usage, roof orientation, roof pitch, shading, system design, inverter and battery settings, electricity tariffs, feed-in tariffs, weather, product performance, grid rules, network limits, future electricity prices and customer behaviour. Final system design and expected performance will be discussed during the quoting process.
4. Payment Terms
Unless otherwise agreed in writing, payment is due within 7 days of invoice. Larger projects, solar and battery works, commercial works, air conditioning projects or staged works may require deposits, progress payments or staged invoices.
5. Rates
The following listed rates exclude GST. GST is charged at 10% where applicable. Standard working hours are Monday to Friday, 6am to 4pm.

After-hours, emergency, weekend, public holiday, specialist equipment, travel, materials, disposal and other project-specific charges may be quoted or charged separately where applicable.
6. Late Payment
Reasonable administration fees, interest or late payment fees may apply where permitted by law and where stated on an invoice, quote or agreed terms. Reasonable debt recovery, collection, legal or enforcement costs may be passed on where permitted by law.
7. Variations
Work outside the original accepted scope may be treated as a variation and may affect price, timing, materials and project scheduling. Customer approval will be sought where practical, except where urgent safety or compliance work is required.
8. Access and Site Conditions
The customer must provide safe and reasonable access to the site and notify Max Power Electrical & Airconditioning of known hazards, including asbestos, structural issues, access limitations, concealed services, unsafe areas or other site risks.
9. Products and Availability
Product availability, model numbers, specifications and lead times may change. Where a quoted product is unavailable or unsuitable, an equivalent alternative may be recommended, subject to customer approval where practical.
10. Warranties and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, statutory right or protection that cannot legally be excluded under Australian Consumer Law or other applicable legislation.
Workmanship warranties are 10 years for solar installation, 5 years for air conditioning installation and 5 years for electrical work, subject to the relevant quote, scope and warranty conditions. Product and manufacturer warranties apply as provided by the relevant manufacturer or supplier documentation.
Warranty coverage may not apply to misuse, unauthorised modifications, failure to maintain, external damage, third-party work, grid events, storm or weather damage, pest damage, customer-supplied products or circumstances outside Max Power Electrical & Airconditioning’s reasonable control.
11. Compliance
Works are carried out to applicable Australian Standards, manufacturer requirements and relevant electrical and safety requirements where applicable.
12. Limitation
Any limitation of liability is intended to apply only to the extent permitted by law. These terms do not exclude liability that cannot legally be excluded and are not intended to be harsh, unfair or misleading.
